The Wisconsin Supreme Court ruled Gov. Evers doesn't have authority to limit restaurant capacity during the COVID-19 pandemic

The Wisconsin Supreme Court ruled against Governor Tony Evers Wednesday morning, finding that he doesn't have the authority to limit the capacity of bars and restaurants during the COVID-19 pandemic without the approval of the state legislature.

The court ruling was 4-3, according to Associated Press correspondent Scott Bauer.

Evers had limited the capacity of indoor dining spots to 25% last year. The restriction was lifted in October after an appeals court put the edict on hold.

This ruling against Evers comes weeks after the court threw out the governor's mask mandate as cases in the state surged.
